These Terms of Use explain the conditions that apply when you access or use the Home Plan Choice website and services. Please read them carefully.

1. Agreement to These Terms

These Terms of Use (“Terms”) govern your access to and use of the website located at https://homeplanchoice.com/ (the “Site”), and any related online forms, communications, or services provided by HOME PLAN CHOICE LLC (“Home Plan Choice”, “we”, “us”, or “our”).

By visiting or using the Site, requesting a callback, or interacting with us through the Site, you agree to these Terms. If you do not agree, you should not use the Site.

2. Who We Are & Our Role

Home Plan Choice is an Independent Referral Partner. We connect customers with participating Internet, TV, home phone, and mobile providers through authorized master-dealer partners. We are not the provider and we:

  • Do not install services;
  • Do not bill for services;
  • Do not manage customer accounts;
  • Do not provide technical support for the services.

All services are provided by the provider you select, subject to that provider’s own terms, conditions, policies, eligibility requirements, pricing, fees, and limitations.

We may receive compensation when you activate service through our referrals, at no additional cost to you.

3. Eligibility & Service Area

The Site is intended primarily for individuals located in the United States who are at least 18 years old (or the age of majority in their jurisdiction). By using the Site, you represent that:

  • You are at least 18 years old (or the age of majority in your location);
  • You have the legal authority to enter into these Terms; and
  • You will use the Site in compliance with all applicable laws and regulations.

Availability of specific services, technologies, and providers varies by location and is determined solely by the providers.

4. No Provision of Services or Guarantees

The information on the Site, including example plans, pricing ranges, and descriptions, is for general informational purposes only and does not guarantee that any particular service, price, promotion, speed, or technology will be available at your address.

Any actual service, pricing, speeds, promotions, equipment, contract terms, and eligibility are determined solely by the provider, and may change without notice. We do not guarantee:

  • Service availability or eligibility;
  • Minimum speeds, performance, or uptime;
  • Any particular promotion, term, or price;
  • That any provider will approve an order, installation, or credit check.

5. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree that you will not:

  • Use the Site in any way that violates any applicable law or regulation;
  • Provide false, inaccurate, or misleading information;
  • Attempt to interfere with or disrupt the Site, servers, or networks;

6. Referral, Providers & Third Parties

When you request that we review availability and options for your address, we may share relevant information with authorized master-dealer partners and participating providers, so they can:

  • Check service availability and eligibility for your address;
  • Present or confirm plan and pricing options;
  • Process orders and coordinate installation or activation;
  • Confirm referrals and commissions, where applicable.

Providers and third-party partners are independent from Home Plan Choice and have their own terms, privacy policies, and practices. We are not responsible for any acts, omissions, errors, or policies of any provider or third party.

7. Prices, Promotions & Example Plans

Any prices, ranges, or plan descriptions shown on the Site are for illustrative or example purposes only and are not guaranteed offers. Actual pricing, promotional terms, fees, and taxes are set solely by each provider and may:

  • Vary by location, technology, or customer eligibility;
  • Change frequently and without notice;
  • Include additional fees, surcharges, or equipment costs.

You should review and confirm the specific terms, pricing, and conditions directly with the provider before placing an order or activating any service.

8. No Professional Advice

Information provided on the Site or by our agents is intended to help you compare and understand provider options, but it does not constitute legal, financial, tax, or professional advice. You are solely responsible for evaluating whether any particular plan or provider meets your needs.

You can opt out of certain marketing communications at any time, such as by replying STOP to a marketing SMS or by following unsubscribe instructions in emails. 13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL HOME PLAN CHOICE, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH:

  • YOUR USE OF OR INABILITY TO USE THE SITE;
  • ANY INFORMATION OR CONTENT PROVIDED ON THE SITE;
  • ANY COMMUNICATIONS OR INTERACTIONS WITH PROVIDERS OR THIRD PARTIES;
  • ANY SERVICES PROVIDED BY THIRD-PARTY PROVIDERS.

TO THE EXTENT ANY LIABILITY IS FOUND, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100), OR THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW IF GREATER.

14. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Home Plan Choice and its owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from or related to:

  • Your violation of these Terms;
  • Your interactions with providers or third parties.

15. Compliance With Laws & Prohibited Uses

You are responsible for complying with all applicable laws and regulations relating to your use of the Site and any services or products you obtain through providers. If we believe your use of the Site violates any law or may pose a risk to us or others, we may take any action we deem appropriate, including limiting or terminating your access.

16. Governing Law & Dispute Resolution

These Terms and your use of the Site are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts, except where prohibited by law.

17. Changes to the Site & These Terms

We may update, modify, or discontinue the Site (or any part of it) at any time, with or without notice. We may also update these Terms periodically. When we do, we will revise the “Last updated” date at the top of this page.

Your continued use of the Site after changes become effective constitutes your acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Site.

18. Entire Agreement

These Terms, together with our Privacy Policy and any additional notices or disclosures on the Site, form the entire agreement between you and Home Plan Choice regarding your use of the Site and supersede any prior or contemporaneous understandings or agreements related to such use.
